Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and Taste Buds ( “we”, “us”, or “our”) and govern your access to and use of the Taste Buds mobile application and the website at mytastebuds.app (together, the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. By using Taste Buds you represent that you meet this requirement and that the information you provide is accurate.

2. Your account

You sign in to Taste Buds using Sign in with Apple. You are responsible for the activity that happens under your account and for maintaining the security of the Apple ID associated with it. Notify us promptly if you believe your account has been compromised.

3. Your content

“Your Content” means the lists, saved places, notes, recommendations, profile details, and anything else you create or submit through the Service. You retain ownership of Your Content.

By submitting Your Content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display it solely to operate and provide the Service — including showing it to the buds and other users you choose to share it with. This license ends when you delete Your Content or your account, except for content others have already saved or shared and for copies retained in routine backups.

You are responsible for Your Content and represent that you have the rights necessary to submit it and that it does not violate these Terms or any law.

4. Acceptable use

You agree that you will not:

• Post or share content that is unlawful, infringing, fraudulent, harassing, hateful, threatening, sexually explicit, or otherwise objectionable.
• Impersonate any person or misrepresent your affiliation.
• Access, scrape, or collect data about other users without their consent, or attempt to access accounts or data that are not yours.
• Interfere with, disrupt, or attempt to gain unauthorized access to the Service or its systems.
• Use the Service to send spam or for any commercial purpose we have not authorized.

5. Objectionable content, reporting, and blocking

Taste Buds is a social product, and we have zero tolerance for objectionable content or abusive behavior. To keep the community safe:

• You can report objectionable content or another user from within the app.
• You can block another user, which prevents them from interacting with you or seeing your activity.
• We review reports and will remove content and suspend or terminate accounts that violate these Terms, generally within 24 hours of a report.

6. Third-party services and content

The Service relies on third-party services and shows information from third-party sources — including restaurant data and search results provided through Google Places. We do not control and are not responsible for the accuracy of third-party content, and your use of third-party services may be subject to their own terms.

7. Intellectual property

The Service, including its software, design, logos, and branding (excluding Your Content and third-party content), is owned by Taste Buds and protected by intellectual property laws. We grant you a limited, personal, non-transferable, revocable license to use the Service for its intended purpose, subject to these Terms.

8. Termination

You may stop using the Service and delete your account at any time from within the app. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination (including content licenses for already shared content, disclaimers, and limitations of liability) will survive.

9. Disclaimers

The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any restaurant or recommendation information is accurate or current.

10. Limitation of liability

To the maximum extent permitted by law, Taste Buds and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, goodwill, or profits, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim or USD $50.

11. Indemnification

You agree to indemnify and hold harmless Taste Buds from any claims, damages, and expenses (including reasonable legal fees) arising out of Your Content, your use of the Service, or your violation of these Terms or the rights of any third party.

12. Apple App Store terms

Because you downloaded the app from the Apple App Store, the following applies:

• These Terms are between you and Taste Buds only, not with Apple. Apple is not responsible for the app or its content.
• Apple has no obligation to provide maintenance or support for the app.
• To the extent permitted by law, Apple has no warranty obligation, and any claims relating to the app are our responsibility, not Apple's.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
• You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government restricted-parties list.

13. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will provide notice through the Service or by other reasonable means. Your continued use of the Service after the changes take effect means you accept the revised Terms. We will update the “Last updated” date above when we make changes.

14. Governing law

These Terms are governed by the laws of Canada, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the courts located there for any dispute that is not subject to other agreed dispute resolution.
